"VSTL Travel & Tours" refers to operating companies. "Agent" refers to Tour Operator and/or their respective Travel Agents making bookings through VSTL Travel & Tours on behalf of their "Clients" (passengers).

All bookings are made through the VSTL Travel & Tours Booking Centre in Phnom Penh.

2. PER PAX SYSTEM
All VSTL Travel & Tours products are based on a "per PAX" system, meaning prices are quoted on a per passenger basis. Children are included in this count, however in many cases discounts apply depending on the age of the child. Please note however that for a “Meal Plan” a child accompanying adults will not be included and will incur an additional meal charge.
It is the Agents responsibility to ensure VSTL Travel & Tours is notified of ALL travelling Clients even if a child is travelling without charge.
3. PAYMENT
All product pricing is quoted in United States Dollars. The invoice is payable at least 15 DAYS PRIOR TO ARRIVAL of the client (start of journey). Payment shall be made in US dollars, into the account specified in the invoice Non-payment in advance will result in cancellation of tour, unless Agent credit terms are arranged in advance with VSTL Travel & Tours. Any cancellation charges levied by suppliers will be charged to Agent.
4. ACCURACY
the data and products provided herein are maintained and updated by VSTL Travel & Tours, our partners and other service providers. All tours, prices and other services displayed are subject to availability and certain terms and conditions. VSTL Travel & Tours cannot be held responsible for any incorrect information featured. However, we take every reasonable measure to ensure that all details are correct at the time of entry. Information and prices provided at time of booking and confirmation shall be considered the most current, however may be subject to further updates and changes.
Transport Timings: All transport (flight, boat, train, bus, car etc) timings are provisional and could be subject to change. Agents will be informed of any major change as soon as VSTL Travel & Tours is notified.
5. SERVICES AND MODIFICATION OF SERVICES
The scope of contractual services rendered by VSTL Travel & Tours is set out in this current confidential tariff and the specifications in the relevant tour confirmation documents received by Agent. Any amendments to and modifications of contractual services only apply when confirmed in writing by VSTL Travel & Tours, who reserve the right to charge additional fees and/or surcharges for such approved change in services rendered.
After commencement of journey:
Any such requests for changes in services rendered once the Client journey has commenced, including changes in itinerary items, will only be permissible subject to receipt of written authorization for such changes and/or additional fees for said services from Agent or payment made directly by Client to VSTL Travel & Tours.
Forced modifications:
Should it become necessary for VSTL Travel & Tours to modify or amend the scope of contractual services rendered through the result of changes in third party supplier services (e.g. changes or cancellation of airline, train, bus, or other transport schedules; hotels overbooked etc.), VSTL Travel & Tours will do its utmost to replace said service(s) - however it may not be possible always to provide an alternate service. VSTL Travel & Tours shall not be held liable for any losses (real or otherwise) as a result of such third party actions.
6. SURCHARGES
The price of Agents tour arrangements can be varied due to changes in third party service costs, e.g. peak season surcharges, fuel surcharges, scheduled airfares, government imposed fees, compulsory meals, Visa increases and any other service surcharges which are imposed on to VSTL Travel & Tours. We will endeavour to notify Agents of such increases as early in advance as possible, however Agent acknowledges that such surcharges are beyond the control of VSTL Travel & Tours and therefore we must pass on such surcharges to Agent/Client.
7. CANCELLATION
If Agent wishes to cancel booked and CONFIRMED services, it must do so in WRITING to the VSTL Travel & Tours BOOKING CENTER in Phnom Penh (contact details above); cancellation fees will apply as follows:
Special cancellation fees may apply if specified in the quotation. In addition, VSTL Travel & Tours may claim losses exceeding the flat rate cancellation fee, whenever proof of such loss can be provided. In such instances, the client is entitled to furnish proof to VSTL Travel & Tours that no loss has yet occurred or that it is considerably lower than the excess amount charged VSTL Travel & Tours is entitled to pass on additional costs to the client if charged for by service providers (e.g. fees for unoccupied beds / seats).
8. INSURANCE
It is a condition of booking with every Agent that Agent ensures its Clients have adequate insurance covered. Such insurance coverage should provide sufficient coverage against unexpected cancellation charges, journey delays, medical costs that might be incurred while travelling overseas, loss of money, or belongings, or personal liability claims. In the event of a claim for loss or damages, in the first instance Client and/or Agent should make such claim through the Insurance provider.
9. SERVICE RATINGS
There is no standard method of rating hotel’s, transport services, guides etc across the world. Many counties have differing official and unofficial ways of assessing these services and some do not rate services at all. Therefore VSTL Travel & Tours has used its discretion to rate services such as Hotel rooms as “Deluxe plus “, “Deluxe”, “First”, “Superior”, and “Medium” etc. Therefore please check with VSTL Travel & Tours at time of booking to clarify which level of service is being booked and to notify Clients of such.
10. WARRANTY & LIABILITY
VSTL Travel & Tours does not give any warranty or representation whatsoever in connection with the accuracy and/or completeness of any information provided pursuant to the service rendered. Where VSTL Travel & Tours supplies in connection with the provision of the service booked and confirmed any goods or services supplied by a third party, VSTL Travel & Tours does not give any warranty, guarantee or other term as to their quality, fitness for purpose or otherwise, but shall, where possible, assign to the Agent the benefit of any warranty, guarantee or indemnity given by the person supplying the goods or services on behalf of VSTL Travel & Tours
VSTL Travel & Tours shall have no liability to the Agent and/or Client for any loss, damage, costs, expenses or other claims for compensation arising from any Input Material or instructions supplied by the Agent which are incomplete, incorrect, inaccurate, illegible, out of sequence or in the wrong form, or arising from late arrival or non-arrival, or any other fault of the Agent and/or Client.
Except in respect of death or personal injury caused by VSTL Travel & Tours 's negligence, VSTL Travel & Tours shall not be liable to the Agent and/or Client by reason of any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the Contract, for any loss of profit or any indirect, special or consequential loss which could not reasonably have been within the contemplation of the parties, damage, costs, expenses or other claims (whether caused by the negligence of VSTL Travel & Tours, its servants or agents or otherwise) which arise out of or in connection with the provision of the Specified Service or their use by the Client, and the entire liability of the commission received by VSTL Travel & Tours from the suppliers for the Client's booking.
VSTL Travel & Tours shall not be liable to the Agent and/or Client or be deemed to be in breach of the Contract by reason of any delay in performing, or any failure to perform, any of VSTL Travel & Tours obligations in relation to the Specified Service, if the delay or failure was due to any act of God, fire, flood, draught or other abnormal weather conditions, war, strike, lock-out or other industrial dispute, civil commotion, riot, malicious damage, breakdown of plant or machinery, default of suppliers, (including, without limitation, any action or omission by any supplier and/or airline).
11. DATA PROTECTION & PRIVACY
VSTL Travel & Tours will respect the privacy of Agent and/or Client’s data which Agent supplies to VSTL Travel & Tours in accordance with VSTL Travel & Tours Privacy Policy. VSTL Travel & Tours will comply with all applicable data protection legislation in respect of it. Agent agrees to keep its Clients data accurate and up to date and promptly to send VSTL Travel & Tours any new or revised Client data. Unless VSTL Travel & Tours has Agents express written consent VSTL Travel & Tours will only disclose Client data to third parties if this is required for the purpose of completing Agents transaction. However, VSTL Travel & Tours may disclose Client data to certain permitted third parties, who are bound by confidentiality codes, and when VSTL Travel & Tours is legally obliged to disclose such data.
12. FLIGHT RECONFIRMATION POLICY
a) If VSTL Travel & Tours booked the flight on behalf of the Tour Operator (domestic or International) then if required ) VSTL Travel & Tours has the obligation to reconfirm the flight for the PAX and/or assist the PAX in making changes etc to the flight(s).
b) If VSTL Travel & Tours did NOT book the flight (domestic or International was booked by PAX or Agent) then POP Destination Travel & Tour is under no obligation to reconfirm for PAX and if PAX wishes to make changes then VSTL Travel & Tours may charge a handling fee for such changes and/or reconfirmation.
c) If an Airline changes a scheduled arrival/departure of a flight that a PAX is booked on (whether or not VSTL Travel & Tours booked the ticket) AND VSTL Travel & Tours is notified of this change IN ADVANCE then VSTL Travel & Tours is obligated to assist the PAX to reconfirm on the new flight time (or alternate flight) and if required to amend or change the PAX itinerary (also to advise TO of such changes).
d) If VSTL Travel & Tours makes a change to a PAX ticketed flight (regardless of who booked the original flight) then VSTL Travel & Tours will RECHECK and RECONFIRM ALL OTHER FLIGHT SEGMENTS PAX is holding, especially international sectors that may be linked to a Domestic transfer. In certain instances, a change to a ticketed flight sector may trigger an automatic cancellation of all other connected sectors (including
International) so it is imperative that VSTL Travel & Tours RECHECK these other sectors and ensure the relevant airline(s) have the updated flight information.
13. GENERAL
Prices quoted apply according to the validity specified in the quotation. Agent is responsible to ensure clients have valid passport, visa and health documents for the countries booked. Any delay, change or cancellation of booking as a result of the passengers passport, visa, health or currency control provisions of the individual country being travelled to, will result in cancellation charges.
If VSTL Travel & Tours agrees to arrange visa services it does so on behalf of the Client and/or Agent and cannot accept any responsibility for delays or Visa refusal by the respective government agencies.
Should any clause or provision of these Terms & Conditions become void or unenforceable, the validity of the remaining Terms & Conditions shall not be affected or impaired thereby.
These Terms & Conditions, including additional Terms & Conditions notified to Agent at time of booking apply in all countries that VSTL Travel & Tours provides services and any action brought against VSTL Travel & Tours & Tour from Agent and/or Client shall be limited to the responsible VSTL Travel & Tours & Tour operations office where the disputed services were rendered.
